EmailValidator provides email validation services including:
• Real-time email address validation via API
• Bulk email list processing and validation
• Email deliverability analysis and reporting
• Integration tools and documentation
• Customer support and account management
3. User Accounts
3.1 Account Creation
You must create an account to use our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Account Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.3 Account Security
You are responsible for safeguarding your API keys and login credentials. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use Policy
You agree not to use the service to:
• Validate email addresses obtained illegally or without proper consent
• Engage in spamming, phishing, or other malicious email practices
• Attempt to circumvent rate limits or usage restrictions
• Reverse engineer, decompile, or attempt to extract our algorithms
• Use the service for any illegal or unauthorized purpose
• Interfere with or disrupt the service or servers
• Violate any applicable laws or regulations
5. Billing and Payment
5.1 Pricing and Credits
Our services are provided on a credit-based system. Credits are consumed for each email validation performed. Current pricing is available on our pricing page and may be updated from time to time.
5.2 Payment Terms
Payment is due immediately upon purchase of credits or subscription plans. We accept major credit cards and process payments through secure third-party payment processors.
5.3 Refunds
Refunds are provided at our discretion and typically only for unused credits within 30 days of purchase. Subscription fees are non-refundable except as required by law.
5.4 Taxes
You are responsible for any applicable taxes, duties, or government charges related to your use of our services.
6. Service Level Agreement
6.1 Uptime Commitment
We strive to maintain 99.9% uptime for our services. Planned maintenance will be announced in advance when possible.
6.2 Performance Standards
We aim to process single email validations within 2 seconds and provide bulk processing results within reasonable timeframes based on list size.
6.3 Rate Limits
API usage is subject to rate limits based on your subscription plan. Exceeding these limits may result in temporary service restrictions.
7. Data and Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of your email data, and we process it solely to provide our validation services.
8. Intellectual Property
8.1 Our Rights
The service and its original content, features, and functionality are owned by EmailValidator and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
8.2 Your Rights
You retain all rights to your email data and any content you provide to us. You grant us a limited license to process this data solely for providing our services.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMAILVALIDATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. EMAILVALIDATOR EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
11. Termination
We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including breach of these Terms. You may terminate your account at any time by contacting us or using the account deletion feature in your dashboard.
12. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the service after such changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be resolved in the courts of San Francisco County, California.
